A grinning and super fit Sam Burgess put his ongoing legal drama aside while having breakfast with his brother and friends at a trendy Bondi cafe after training.

The embattled NRL legend has held back on his marital problems and way of partying since the Australian posted a bombshell report.

Burgess, 31, and his brother Luke ventured out of the Coogee unit they now share for a class at Air Locker Training in Bondi Junction on Friday morning.

After the former South Sydney Rabbitohs champion smiled and laughed as he ate at a nearby cafe with his training partners after training.

An ever more sociable Burgess was seen chatting with celebrity chef Scott Findlay, brother Luke, his girlfriend Tori May, and a crowd of locals.

At one point, the NRL champ laughed out loud after stepping away from the table to take a call.

Then he returned to say goodbye to his brother's girlfriend before patting his older brother on the chest as he left.

High altitude gym workouts seem like a weekly event for the two Burgess brothers, who joined Luke's daughter Grace last week.

Burgess' training came just days after targeting ex-wife Phoebe for allegedly posting a private police statement to The Australian in advance of her bombshell.

Attorney Bryan Wrench for Burgess told Moss Vale District Court on Wednesday that the release of Phoebe's statement was part of an attempt to "ambush" his client.

Mr Wrench has accused Phoebe or her father of divulging allegations about Burgess published in The Australian on October 2.

Burgess has hired Sydney's top lawyer, Phillip Boulten SC, who also represents former NRL star Jarryd Hayne on rape, to act for him.

Burgess is defending a charge of intimidation against Phoebe's father, Mitchell Hooke, who is the subject of a preliminary arrest of violence protecting him from the retired South Sydney captain.

Mr Wrench has accused Phoebe or her father of divulging allegations about Burgess published in The Australian on October 2.

He seeks access to Phoebe's testimony and objections that have appeared in the media without being advertised in court.

"The circumstances surrounding the release of this statement confirm the hostility towards my client," said Wrench.

"They tried to attack us."

Mr Wrench said police confirmed that Phoebe made the statement late last month, just days before the content was released.

"At one point a statement was made which was presented to the Australian," Wrench told the court.

"The police never published this statement to the Australian."

Mr Wrench has suggested that the document was deliberately leaked to the media prior to the hearing of the intimidation charge.

The blissful photo comes after an article in the Australian newspaper last week that contained bomb allegations about Burgess' behavior towards his ex-wife Phoebe and allegations of excessive partying.

The allegations have sparked an investigation by the NRL Integrity Unit and the start of a police strike while Burgess stepped down from his off-field coaching role with the Rabbitohs and commentary on Fox Sports.

Burgess media attorney Mark O'Brien said: "The allegations are false and constitute an unjustifiable slander against my client.

"It is evident that the sources of the false allegations are those currently disputed with my client on various issues."

His criminal defense attorney, Mr Wrench, has now raised concerns about the Australian article and its origins twice in court.

"To be very clear, it appears that this was either out of malice or out of retaliation," Wrench told the court.

As part of the article, Souths employees were also charged with ignoring Burgess' alleged indiscretions.

The main allegations included allegations of an incident at the Burgess home in Maroubra, east Sydney, in vember 2018, in which he behaved erratically.

A former Burgess teammate is due to be questioned by police this week about Zoom from the UK, where he plays in the English Super League.

Jason Clark was the person Phoebe Burgess turned to during the 2018 incident with Sam at her home, the Australian reported.

Evidence Clark gives the police could be an important part of the investigation into Burgess and South Sydney, as well as the team's medical staff.

Clark had visited the couple's home with Burgess' mother Julie, who had brought Sam and older brother Luke home from a city hotel.

Detectives have already interviewed Phoebe and visited several relevant locations, including an underground car park where Burgess allegedly received medical treatment.

A pharmacy associated with club doctor Andrew McDonald was also reportedly visited by police.

Souths co-owner, Hollywood star Russell Crowe, could be called upon to testify ahead of the NRL investigation.

Burgess has been hiding in his home in Coogee, east Sydney, since the allegations were made public.

The allegations against him have "devastated him," a close friend told The Daily Telegraph.

WHO IS THE BURGESS FAMILY?

JULIE: The family matriarch, a former assistant headmistress, is known for always defending her four boys. She followed her sons to Australia in 2012 after pursuing careers at South Sydney

MARK: The boys' father died in 2007 at the age of 45 after a long battle with motor neuron disease. While their towering height comes from Julie, Mark is credited with giving boys their muscle and toughness.

Hatch: As the oldest of the four boys, he is known to his brothers as "Biffa". Luke moved to Australia in 2011 to play for South Sydney. He started dating model Yolanda Hodgson and the couple have a daughter, Grace, who split in 2019.

SAM: As the first of the family to move to Sydney, it quickly became an integral part of the Rabbitohs outfit. After a few years together, he married Phoebe Hooke in 2015, before they split publicly in late 2018. They have two children, Poppy and Billy.

TOM: Tom and his twin brother George are the youngest members of the family. He was the last of the family to move to Australia in 2011. He is engaged to Tahlia Giumelli and the couple are currently expecting a second child.

GEORGE: The 28-year-old has returned to England to play in the Super League after marrying his wife Joanna in 2016. The couple have three children under the age of three.

"He's angry and feels like he doesn't have a voice," said the friend.

"(The allegations are) something he detests, which makes it all the more difficult to take."

Burgess retired last October after a series of injuries but stayed with the club where he worked as a development coach.

Souths CEO Mr Solly said he was unaware of the Australian's allegations until he was contacted by journalists.

Club coach Wayne Bennett said he was also unaware of the allegations.

"I've been here since 2018 and didn't know about it until I was told in the last 24 hours," said Bennett.

Ms. Burgess stays with her family in Bowral and takes care of the two young children she shares with Burgess.

Her manager Sharon Finnigan said, "Phoebe is trying to get by and manage and care for her two children. She does her best as a single mother."

The former couple married at Phoebe's parents' house in December 2015 and separated in December 2018, weeks after the birth of their son Billy.

The couple had revived their relationship until April 2019, but split again last October.

Their divorce was finalized in April. They also have an older daughter, Poppy.
